Joining the WBTC provides members and their families with exclusive access to the tennis court and four pickleball courts that are located on Anderson Way in the Wingaersheek Association.
PRIOR TO REGISTRATION PLEASE READ THE WBTC RELEASE AND WAIVER OF LIABILITY and add your name and check the box which confirms you've read the agreement.
WINGAERSHEEK BEACH AND TENNIS CLUB RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, PARENTAL CONSENT AND INDEMNITY AGREEMENT
IN CONSIDERATION of being permitted to participate in tennis and/or pickleball (“Activities”) on the Wingaersheek Beach and Tennis Club courts, (“WBTC Courts”) I, for myself, family members, assigns, heirs, dependents, and next of kin:
1. Acknowledge and fully understand that: (a) any use of the WBTC Courts and any participation in such Activities comes with inherent risks including, but in no way limited to: (1) personal injury, (2) property damage, (3) disability, (4) death, and (5) sickness or disease. (“Risks”); (b) these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activities, the condition of the WBTC Courts and property where the Activities take place, or the negligence of the “Releasees” named below; (c) there may be other Risks and economic losses either not known to me or not readily foreseeable at this time; and (d) I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR INJURIES, LOSSES, COSTS, AND DAMAGES THAT I OR MY FAMILY MEMBERS incur as a result of our participation in the Activities.
2. Hereby consent to receive medical treatment on an emergency basis in the event of injury, accident and/or illness during my or my family members’ participation in Activities at the WBTC Courts. I agree to hold the Releasees harmless for any claims resulting from any medical treatment I or my family members may receive.
3. Hereby RELEASE, DISCHARGE, AND COVENANT NOT TO SUE the Wingaersheek Beach and Tennis Club and any of its officers, members, or other participants (each considered one of the “RELEASEES” herein) FOR ANY AND ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, INJURIES, OR DAMAGES CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE CONDITIONS OF THE WBTC COURTS AND PROPERTY, NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS. I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, PARENTAL CONSENT AND INDEMNITY AGREEMENT, I or my family members, or anyone on our behalf, makes a claim against any of the RELEASEES, THAT I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney’s fees, losses, liabilities, damages, or costs which may occur as the result of such claim.
